Terms of Service

1. Acceptance of Terms

By accessing and using this App, you agree to be bound by these Terms of Service. If you do not agree to any part of these terms, you may not use the App. We reserve the right to modify these terms at any time, and your continued use constitutes acceptance of changes.

2. Use License

We grant you a limited, non-exclusive, non-transferable license to use this App for personal, non-commercial fitness tracking and coaching purposes. You agree not to:

  • • Reverse-engineer, decompile, or modify the App
  • • Use the App for commercial purposes or resale
  • • Access the App through unauthorized means
  • • Attempt to harm, disrupt, or interfere with the App's functionality
  • • Copy or reproduce content without permission
  • • Use the App to harass, threaten, or defame others

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information during registration and keep it current. You are liable for unauthorized access to your account. Report suspicious activity immediately.

4. Subscription and Billing

Free Tier: Unlimited access to basic features at no cost.

Paid Subscriptions: Recurring charges billed monthly or annually. Subscription continues until cancelled.

Billing: All charges are processed through Stripe. By subscribing, you authorize recurring charges to your payment method.

Trial Periods: Some plans may include free trial periods. Your subscription will automatically convert to paid unless cancelled before the trial ends.

Refunds: We do not offer refunds for partial months or unused subscription periods. You may cancel anytime and retain access through the end of your billing cycle.

Price Changes: We may change pricing with 30 days' notice. Changes apply to new billing cycles, not active subscriptions.

5. Cancellation

You can cancel your subscription anytime through the billing portal or settings. Cancellation takes effect at the end of your current billing cycle. No refunds are issued for cancellations mid-cycle.

6. Content and Data Ownership

You retain ownership of all data you input into the App (workouts, nutrition logs, photos, notes). By using the App, you grant us a license to use your data to provide the service, generate insights, and improve the App. We will not use your data for purposes other than stated in the Privacy Policy.

7. Disclaimer of Warranties

The App is provided "AS IS" without warranties of any kind. We do not warrant that the App will be error-free, uninterrupted, or meet your expectations. We are not liable for:

  • • Inaccuracies in generated programs or recommendations
  • • Loss or corruption of data
  • • Service interruptions or downtime
  • • Injuries resulting from following App recommendations

8. Health and Safety Disclaimer

This App is for informational purposes and does not replace professional medical or fitness advice. Generated programs and nutrition recommendations are AI-generated and not personalized by licensed trainers or nutritionists. Always consult a healthcare provider before starting any new fitness or nutrition program, especially if you have existing health conditions. You assume all risks related to your use of the App.

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, including lost profits or data loss, even if we have been advised of the possibility of such damages. Our total liability is limited to the amount you paid for your subscription in the past 12 months.

10. Indemnification

You agree to indemnify and hold harmless the App and its operators from any claims, damages, or costs arising from your violation of these terms, misuse of the App, or violation of any applicable laws.

11. Termination

We may terminate or suspend your account immediately, without notice, if you violate these terms or engage in harmful behavior. Upon termination, your right to use the App ceases immediately. Data retention is subject to our Privacy Policy.

12. Third-Party Services

The App integrates with third-party services (Stripe for payments, cloud services for storage, etc.). These services have their own terms and privacy policies. We are not responsible for their practices or outages.

13. Intellectual Property

All App content, design, code, and materials are our intellectual property or licensed from third parties. You may not copy, modify, or distribute without permission. User-generated content (workouts, notes) does not transfer ownership of our App materials.

14. Governing Law

These Terms are governed by the laws of Nova Scotia, Canada, without regard to conflict of laws principles. Any disputes shall be resolved in the courts of Nova Scotia.
